I NSTRUCTIONS TO B IDDERS
Unless otherwise specified in the BDS, the Bidder may subcontract parts of the Works to an extent acceptable to the procuring entity and specified in the BDS. In the event that a subcontractor is found by the procuring entity to be ineligible, subcontracting of such part of the works shall not be permitted. Statement of the bidder's SLCC corresponding to the contract to be bid in accordance with ITB clause 5.4.

The name of the project is Negotiated Procurement for the Construction of Performing Arts Theater in Bulanao Campus (Package Contract). The minimum work experience requirements for key personnel on each project lot are as follows:.
Civil Engineer/Building Engineer 3 years 3 years Vocational/Registered Electrical Engineer 3 years 3 years Sanitary Engineer/Plumber 3 years 3 years Construction Safety and Health Officer 3 years 3 years. G ENERAL C ONDITIONS OF C ONTRACT
The completion date is the date of completion of the works as certified by the Procuring Entity's Representative, in accordance with Clause 49 of the GCC. All materials and plants at the site will be considered the property of the Procuring Entity. The Contractor shall comply with all instructions of the Procuring Entity Representative that are consistent with the laws in force where the Location is located.
The performance guarantee remains valid until the issue of the certificate of final acceptance by the contracting authority. The contracting authority terminates this contract for default if any of the following conditions accompany its performance:. In the absence of the CPES assessment sheet, the contracting authority's existing performance monitoring system will be applied.
All drawings prepared by the contractor for the performance of the temporary works are subject to prior approval by the contracting authority's representative before being used. The approval of the contracting authority's representative does not diminish the responsibility of the contractor for the design of the temporary work. The Contractor shall obtain third party approval for the design of the Agency Work, if required by the Contracting Authority.
Each completed form will be verified and signed by the Representative of the Procuring Entity within two days of the completion of the work. Approval of the Work Program by the Procuring Entity's Representative will not change the Contractor's obligations. Either the Procuring Entity's Representative or the Contractor may require the other to attend a Management Conference.
Such payment request is verified and certified by the contracting authority's representative/project engineer. The contractor shall submit to the representative of the contracting authority monthly statements of the estimated value of the work performed less the previously certified cumulative amount. The contracting authority's representative checks the contractor's monthly statement and certifies the amount to be paid to the contractor.
S PECIAL C ONDITIONS OF C ONTRACT
NOTE: The duration of the contract is counted from the start date (NTP) and not from the effective date of the contract. The Contractor shall clean the entire area by removing dirt, debris, paint stains, excess and spillage and shall leave the entire premises free of debris caused by their work to the satisfaction of KSU at no additional cost.
The contractor undertakes to pay any fees or charges due to any government agency or other duly established authority in connection with the construction project. He assumes responsibility therefor and the contractor is in particular liable for any responsibility arising therefrom.
